Terms of Use

These Terms of Use (hereinafter referred to as “the Terms”) set forth the conditions for using the services (hereinafter referred to as “the Services”) provided on this website by Okatsune Seito Co., Ltd. (hereinafter referred to as “the Company”).
Registered users (hereinafter referred to as “Users”) are required to use the Services in accordance with these Terms.

Article 1 (Scope of Application)

  1. These Terms shall apply to all relationships between the User and the Company regarding the use of the Services provided on this website.

  2. In addition to these Terms, the Company may establish various rules and guidelines (hereinafter referred to as “Individual Provisions”) concerning the use of the Services. Regardless of their titles, such Individual Provisions shall constitute a part of these Terms.

In the event of any inconsistency between the provisions of these Terms and the Individual Provisions, the provisions of the Individual Provisions shall prevail unless otherwise specifically provided.

Article 2 (User Registration)

  1. To use the Services, an individual who wishes to register must agree to these Terms and apply for registration using the method prescribed by the Company. Registration shall be deemed complete upon approval by the Company.

  2. The Company may decline a registration application if it determines that any of the following circumstances apply. The Company shall not be obligated to disclose the reasons for such refusal.

a. The applicant has provided false information in the registration process.
b. The application is from an individual who has previously violated these Terms.
c. Any other case in which the Company deems the registration inappropriate.

Article 3 (Management of User ID and Password)

  1. Users shall be responsible for appropriately managing their User ID and password for the Services at their own risk.

  2. Under no circumstances may Users transfer, lend, or share their User ID and password with any third party.
    If a login is performed using a combination of User ID and password that matches the registered information, the Company will consider it to be use by the registered User.

  3. The Company shall not be liable for any damages resulting from the use of a User ID and password by a third party, except in cases where such use is due to the Company’s intentional misconduct or gross negligence.

Article 4: Prohibited Activities

  1. Users shall not engage in any of the following acts when using the Services:

  2. Acts that violate laws or public order and morals

  3. Acts related to criminal activity

  4. Infringement of copyrights, trademarks, or other intellectual property rights contained in the Services

  5. Actions that damage or interfere with the functionality of servers or networks of the Company, other users, or third parties

  6. Commercial use of information obtained through the Services in ways not authorized by the Company

  7. Acts that may disrupt the operation of the Company’s Services

  8. Unauthorized access or attempts to gain such access

  9. Collection or accumulation of personal information about other users

  10. Use of the Services for fraudulent purposes

  11. Acts that cause disadvantage, damage, or discomfort to other users or third parties

  12. Impersonation of other users

  13. Advertising, solicitation, or business activities on the Services without the Company’s permission

  14. Acts aimed at meeting strangers of the opposite sex

  15. Providing benefits directly or indirectly to antisocial forces in connection with the Company’s Services

  16. Any other acts deemed inappropriate by the Company

Article 5 (Suspension of Service Provision, etc.)

  1. The Company may suspend or interrupt the provision of all or part of the Services without prior notice to the User if it determines that any of the following circumstances apply:

  2. When performing maintenance or updates on the computer systems related to the Services

  3. When the provision of the Services becomes difficult due to force majeure events such as earthquakes, lightning, fire, power outages, or natural disasters

  4. When computers or communication lines are stopped due to accidents

  5. When the Company otherwise determines that it is difficult to provide the Services

Article 6 (Usage Restrictions and Cancellation of Registration)

  1. The Company may, without prior notice, restrict the User’s access to all or part of the Services or cancel the User’s registration if any of the following apply:

  2. The User has violated any provision of these Terms

  3. False information is found in the registration details

  4. The User fails to respond to communications from the Company within a certain period

  5. The User has not used the Services for a certain period since their last use

  6. The Company otherwise determines that the use of the Services by the User is inappropriate

  7. The Company shall not be liable for any damages incurred by the User as a result of actions taken under this Article.

Article 7 (Withdrawal from Membership)

Users may withdraw from the service by following the withdrawal procedures specified by the Company.

Article 8 (Disclaimer of Warranties and Limitation of Liability)

  1. The Company makes no express or implied warranties that the Service is free from factual or legal defects (including but not limited to defects in safety, reliability, accuracy, completeness, effectiveness, fitness for a particular purpose, or security, as well as errors, bugs, or infringement of rights).

  2. The Company shall not be liable for any damages incurred by users arising from the Service, except in cases of willful misconduct or gross negligence by the Company. However, if the contract between the user and the Company regarding the Service (including these Terms) constitutes a consumer contract under the Consumer Contract Act of Japan, this disclaimer shall not apply.

  3. Even in cases where the exception in the preceding paragraph applies, the Company shall not be liable for any damages arising from special circumstances (including cases where the Company or the user foresaw or could have foreseen the occurrence of such damages) resulting from non-performance or tort due to the Company’s negligence (excluding gross negligence). Furthermore, compensation for damages caused by non-performance or tort due to the Company’s negligence (excluding gross negligence) shall be limited to the amount of usage fees received from the user in the month in which the damage occurred.

  4. The Company shall not be responsible for any transactions, communications, or disputes between users and other users or third parties in connection with the Service.

Article 9 (Changes to Service Content, etc.)

The Company may change, add to, or discontinue the content of the Services with prior notice to the User, and the User shall be deemed to have agreed to such changes.

Article 10 (Amendment of Terms of Use)

  1. The Company may revise these Terms without obtaining the individual consent of Users in the following cases:

a. When the revision is in the general interest of the Users
b. When the revision does not conflict with the purpose of the Service Agreement, and is reasonable in light of the necessity of the change, the appropriateness of the revised content, and other relevant circumstances

  1. In the event of a revision under the preceding paragraph, the Company shall notify Users in advance of the fact that the Terms will be amended, the content of the amended Terms, and the effective date of the changes.

Article 11 (Handling of Personal Information)

The Company shall appropriately handle personal information obtained through the use of the Services in accordance with its [Privacy Policy].​

Article 12 (Notices and Communications)

Notices or communications between the User and the Company shall be conducted using the method specified by the Company.
Unless the User submits a change request in the manner separately prescribed by the Company, the Company shall consider the currently registered contact information to be valid and shall send notices or communications to that contact. Such notices or communications shall be deemed to have reached the User at the time of transmission.

Article 13 (Prohibition of Assignment of Rights and Obligations)

The User may not assign, transfer, or offer as collateral their contractual status under the Service Agreement, or any rights or obligations under these Terms, to any third party without the prior written consent of the Company.

Article 14: Governing Law and Jurisdiction

  1. The interpretation of these Terms shall be governed by the laws of Japan.

  2. In the event of any dispute arising in connection with the Service, the court having exclusive jurisdiction shall be the court with jurisdiction over the location of the Company's head office
